Trespass to Land

Category: legal

The intentional and unauthorized physical invasion of another person’s real property.

Trespass to land can occur by physical entry, or even by causing an object (like toxic fumes or a discarded item) to enter the property. The owner does not need to show actual physical damage to the land to prove trespass; the mere unauthorized presence is enough.

Common Examples

  • The neighboring landowner’s decision to dump construction debris over the fence line was a clear-cut case of trespass to land.
  • The court granted an injunction for trespass to land, ordering the defendant to immediately remove the unauthorized structure.
