Trespass to Land

The intentional and unauthorized physical invasion of another person’s real property.
Trespass to land can occur by physical entry, or even by causing an object (like toxic fumes or a discarded item) to enter the property. The owner does not need to show actual physical damage to the land to prove trespass; the mere unauthorized presence is enough.
Common Examples
- The neighboring landowner’s decision to dump construction debris over the fence line was a clear-cut case of trespass to land.
- The court granted an injunction for trespass to land, ordering the defendant to immediately remove the unauthorized structure.
