Nuisance

A type of tort where a defendant’s activity unreasonably interferes with another’s use and enjoyment of their land.

A nuisance doesn’t involve someone physically entering your land (that’s trespass). Instead, it involves things coming off their land—like excessive noise, foul odors, bright lights, or vibrations—that make your property uninhabitable or less enjoyable.

Common Examples

  • The chemical plant’s constant low-frequency vibration and chemical smell constituted a private nuisance for the nearby residential homeowners.
  • To prove nuisance, the plaintiff must show that the interference is substantial and unreasonable given the character of the neighborhood.
